​Professional and Statutory Regulatory Requirements for ADHD Diagnostic Assessors in the United Kingdom

Legal & Regulatory Summary

To be recognized by the NHS (ICBs), employers, and educational bodies, UK ADHD assessments must comply with statutory regulations and NICE Guideline NG87.

1. Who Can Diagnose ADHD

Only specialist clinicians with active statutory registration and neurodevelopmental expertise can legally diagnose ADHD. Non-statutory counselors, academic psychologists, and ADHD coaches cannot independently diagnose.

  • Recognized Regulators & Clinicians:

    • GMC: Consultant Psychiatrists and Consultant Paediatricians.

    • HCPC: Clinical/Counselling Psychologists, Specialist OTs, and SLTs.

    • NMC: Specialist Mental Health Nurses and ANPs.

    • GPhC: Specialist Clinical Pharmacist Prescribers with neurodevelopmental training.

    • SWE: Specialist Mental Health Social Workers (within neurodevelopmental teams).

(Note: Membership in professional societies like BPS, RCOT, or BACP does not confer diagnostic authority.)

2. Clinical Standards & Shared Care

  • Assessment Standards: Evaluations require structured interviews (DIVA-5/ACE), developmental histories, observer input, and differential diagnoses.

  • MDT & Sign-off: Allied Health Professionals and Social Workers can evaluate within a Multidisciplinary Team (MDT), but standalone diagnoses often require sign-off by a Consultant Doctor (GMC) or Clinical Psychologist (HCPC).

  • Medication & Shared Care: Only registered prescribers (GMC, NMC, GPhC) can initiate medication. For NHS GPs to accept Shared Care Agreements or Right to Choose (England) referrals, the provider must be CQC-registered and use statutory-registered clinicians.
